Advanced Tree Technology guarantees that the plants supplied will be in a live and healthy condition for growing. We cannot guarantee to keep plants alive against all odds. Once the plants have left our control, it is the responsibility of the grower to look after them properly and to follow the planting instructions we provide. If they are found not to be in this condition upon arrival notify Advanced Tree Technology immediately at (260) 749-0891. If you have any problems or questions use this number. The plants must be returned with the original shipping label within THREE DAYS. All claims will be void if the original shipping label is not presented.

The proprietors of Advanced Tree Technology believe their products are in sound condition at the time of sale. The proprietors will not be held responsible for growing error, courier error, delivery difficulty due to an insufficient address or weather conditions. They will only be liable for the loss of any subject plants, provided it can be shown that the plants were defective. In such events, the liability of the proprietors shall extend to the replacement only of the the plant or plants (this does not include shipping), provided the loss occurs within EIGHT WEEKS of the date of shipment and provided written notice is given to the proprietors within that time. The original shipping label should be included with this notice, and claims will be void if the shipping label is not presented. Success with these plants depends on completely following the planting instructions included with each set of material. Advanced Tree Technology will not be held liable if these instructions are not followed. WITHOUT LIMITING THE FOREGOING, THERE IS NO IMPLIED WARRANTEE OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE PLANTS. THE SALE TRANSACTION IS STRICTLY ON AN “AS IS” BASIS. IN NO EVENT SHALL ADVANCED TREE TECHNOLOGY BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDED, BUT NOT BY WAY OF LIMITATIONS, ECONOMIC LOSSES AND LOST PROFITS) INCURRED OR CLAIMED BY THE CUSTOMER.
